18 U.S.C. § 2257 Exemption Statement

1. Statement of Exemption

All visual depictions appearing on or through pornize.ai (the "Service") are entirely computer-generated by artificial-intelligence models operating on user-supplied source imagery. No visual depiction on the Service portrays an actual, identifiable human being engaged in actual sexually explicit conduct.

Accordingly, the Service and its operator are not "producers" as that term is defined in 18 U.S.C. §§ 2257 and 2257A or the implementing regulations at 28 C.F.R. Part 75, and the record-keeping and labeling requirements of those provisions do not apply to material generated through the Service.

To the extent any such requirements are ever deemed applicable, the operator invokes all available statutory and constitutional defenses, including the safe harbors recognized in Free Speech Coalition v. Reno, 220 F.3d 1113 (9th Cir. 2000) and its progeny with respect to wholly synthetic imagery.

2. Safeguards Against Depiction of Real People

To prevent the Service from being used to produce content that depicts identifiable real individuals, every uploaded source image is screened by automated systems before generation begins:

  • Google Cloud Vision face detection automatically rejects any image containing a human face.
  • On-device model checks provide a second layer of screening for faces and other disallowed content.
  • Attempts to circumvent these controls result in account termination under Section 10.2 of the Terms of Service.

3. User Obligations

Every user of the Service represents and warrants, as a condition of use, that:

  • They own or have appropriate rights to any source imagery they upload.
  • They will not use the Service to create content depicting any real, identifiable individual without that individual's consent.
  • They will not attempt to defeat, bypass, or otherwise circumvent the automated content-safety systems described above.

These obligations are set out in full in Sections 6.2 and 6.3 of the Terms of Service.

4. Adults-Only Service

The Service is intended solely for adults aged 18 years or older. By accessing or using the Service, every user represents and warrants that they are at least 18 years of age. This requirement is set out in Section 2 of the Terms of Service.

5. Reporting Concerns

If you believe that any content on the Service depicts a real, identifiable individual without consent, depicts a minor, or otherwise violates these safeguards, please report it immediately through our Content Removal & Complaints procedure.
